Do I need an ADR advisor?
If your company deals with dangerous goods – for example, you transport, store or load them – you may be wondering whether you need a Dangerous Goods Safety Adviser (DGSA).
When is DGSA mandatory?
According to the regulations, if your company transports dangerous goods or is involved in their packaging, loading or unloading, you must appoint an ADR advisor. This results from several legal acts, including:
- ADR Agreement (i.e. international regulations on the transport of such goods),
- Act on the Transport of Dangerous Goods (Polish act),
- Regulation on ADR advisors (Polish regulation).
When is DGSA not needed?
However, you do not always need one. If you transport small quantities of dangerous goods (e.g. under the so-called exemptions – LQ, or "limited quantities"), you do not have to appoint an advisor. The same applies to companies that transport such goods occasionally and in small quantities that do not pose a significant risk.
What are the consequences of not having DGSA?
If your company should have an ADR advisor but does not appoint one, you may be subject to a financial penalty – in Poland up to PLN 5,000. The Road Transport Inspection in Poland may impose additional sanctions if it detects irregularities during an inspection.
Is it worth having DGSA?
Even if you do not formally have to have an ADR advisor, it is worth using their help. Such an expert will help you adapt your company to the regulations, avoid penalties and increase transport safety.
